Conditions of Entry

 

General

  1. Information on how to enter and prize details form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant. Entry is via the Internet or a mobile Internet enabled device only (carrier’s standard data charges apply).
  2. The “Promoter” is Simply Energy (ABN 67 269 241 237) a partnership comprising IPower Pty Ltd (ACN 111 267 228) and IPower 2 Pty Ltd (ACN 070 374 293) (Simply Energy) of Level 33 Rialto South Tower, 525 Collins Street, Melbourne, Victoria, 3000, telephone: 13 88 08, in conjunction with Hawthorn Football Club Limited (ABN 26 005 068 851) (Hawthorn Football Club) of Ricoh Centre, Stadium Circuit, Mulgrave, Victoria, 3170, telephone: 03 9535 3000.

Prizes on Offer

  1. Total maximum prize value is estimated at $500.  The prize is not exchangeable or transferable and cannot be taken as cash (unless otherwise indicated). The prize must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any variation in prize value. The Promoter accepts no responsibility for any tax implications that may arise from prize winnings. Independent financial advice should be sought. The prize value is the recommended retail price including GST (if applicable).
  2. The first eligible entry randomly drawn from all entries in both draws received during the Promotional Period will win one (1) of the following prizes:
    1.  “Coin Toss”: winner will toss the coin at the Hawthorn v Port Adelaide AFL match at the Etihad Stadium on Friday August 21, 2015; or
    2. “Junior Mascot”: winner’s nominated child will be a junior mascot at the Hawthorn v Port Adelaide AFL match at the Etihad Stadium on Friday August 21, 2015. The child must be aged between 6-12 years at the time of match.
    3. A prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.

Eligibility

  1. To be eligible for a prize, you must:
    1. be a Victorian resident; and
    2. 18 years of age or over; and
    3. register your details as set out below to receive a call from the Promoter regarding an offer for the supply of energy and related benefits from the Hawthorn Football Club.
    4. All employees, including directors and management, of the Promoter, the immediate family members of the Promoter, and its related bodies corporate, suppliers, subcontractors and agents whom are directly associated with the conduct of this promotion are ineligible to enter the promotion.
    5. Entrants can choose whether to enter the draw for either the Toss the Coin competition or Junior Mascot competition, or both. Entrants can only enter in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion and all entries of an entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid.
    6. The Promoter reserves the right to request the entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the entrant’s identity, eligibility to enter and claim the prize, and any information submitted by the entrant in entering the promotion, before issuing the prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an entrant or entry has not been verified or validated to the Promoter’s satisfaction, all the entries of that entrant will be ineligible and deemed invalid.

When to Enter

  1. Entries open 14 July 2015 at 9:00am (AEST) and close on 6 August 2015 at midnight (AEST) (Promotional Period).
  2. Entries will be deemed accepted at the time of receipt by the Promoter, and not the time of transmission. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries. Entries must be received by the Promoter during the Promotional Period.

 

How to Enter

  1. To enter, entrants must, during the Promotional Period, visit the Hawthorn Football Club’s website (www.hawthornfc.com.au/simplyenergy) or the Hawthorn Football Club’s mobile applications (via their compatible mobile device in the manner required) (each a Promotional Platform) and:
    1. fully and correctly complete and successfully submit the online entry form via the Promotional Platform in accordance with the instructions provided on the Promotional Platform; and
    2. provide any applicable personal information required by the Promotional Platform. Such information may include, but is not limited to, the entrant’s name, residential address, age, current and valid email address and contact telephone number.

Number of Entries permitted

  1. Each individual can enter only once and only one entry is permitted per residential address. Please note entrants can choose whether to enter the draw for either the Toss the Coin competition or Junior Mascot competition, or both.

Draw of winners

  1. The winners will be drawn at random from all eligible entries for each prize by the Promoter at Level 33 Rialto South Tower, 525 Collins Street, Melbourne, Victoria 3000 at 2:00pm Monday August 10, 2015.
  2. The winners will be notified by telephone and in writing (email) from the Hawthorn Football Club by 13 August, 2015.
  3. All reasonable steps to notify the winners of the results of the draws will be taken by the Promoter.
  4. The Promoter may conduct a further draw/s at the same time (AEST) and place as the original draws as is necessary on 18 August 2015 in order to distribute the prize if unclaimed by that date, subject to any written directions given under applicable State or Territory legislation. In the event of any winner in the unclaimed prize draw/s, the winner will be notified in accordance with condition 15.
  5. The Promoter’s decision is final and no correspondence will be entered into.

Further Terms and Conditions

  1. The Promoter and its related bodies corporate are not:
    1. liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained in connection with taking the prize or using the prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).   The Promoter and its related bodies corporate take no responsibility for any prize damaged or lost in transit, where relevant.
    2. responsible for any problems, delays or technical malfunction or failures, traffic congestion on a network or a mobile network or any combination thereof, or any other technical problems related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion; and
    3. responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.
    4. By participating in the promotion, entrants acknowledge and agree:
      1. to granting the Promoter an irrevocable,  royalty free, worldwide, non-exclusive, perpetual licence to use and publish the winning entrant's name, image, photograph, voice recording, video or entry form for the purpose of promoting the promotion and future promotions, the goods and services produced, manufactured, distributed or supplied by the Promoter, and the Promoter; and
      2. to Simply Energy using the entrant’s personal information from the entry form to contact the entrant in the future with information on special offers or to provide the entrant with marketing materials via any medium including mail, telephone and commercial electronic messages or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future.
      3. Where the entrant is the winner of the Junior Mascot prize, the entrant acknowledges and agrees:
        1. the parent or legal guardian of the child accepting the prize will be responsible for the child on the day; and
        2. to grant the Promoter an irrevocable,  royalty free, worldwide, non-exclusive, perpetual licence to use and publish the child’s name, image, photograph, voice recording or video for the purpose of promoting the promotion and future promotions, the goods and services produced, manufactured, distributed or supplied by the Promoter, and the Promoter.
        3. Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of a Promotional Platform or the information on a Promotional Platform, or to undermine the operation of this promotion may be a criminal and civil offence. Should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Conditions of Entry or any other legal obligation by an entrant, the entrant agrees to indemnify the Promoter for those losses, damages and costs.
        4. An entry, and any copyright subsisting in an entry, irrevocably becomes, at time of entry, the property of the Promoter.
        5. If this promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the promotion and/or if necessary to provide an alternative prize to the same value as the original prize, subject to any written directions made under applicable State or Territory legislation.
        6. The Promoter reserves the right to verify the validity of any and all entries and reserves the right to disqualify any entrant for:
          1. tampering with the entry process;
          2. submitting an entry which is not in accordance with these Conditions of Entry; or
          3. unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion.

The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

Privacy Collection Statement

  1. Simply Energy collects, uses, discloses and stores the entrant’s personal information for the purpose of including the individual in the promotion, and where appropriate, award the prize. If the personal information requested is not provided, the entrant cannot participate in the promotion. We may use the entrant’s personal information in accordance with these Conditions of Entry and our Privacy Policy, including, but not limited to, contacting the entrant in the future with information on special offers or to provide the entrant with marketing materials.
